（一九八三年八月十七日國務院批準） 一、中國公民同外國人（包括常駐我國和臨時來華的外國人、外籍華人、定居我國的僑民）在中國境內自愿結婚的，男女雙方當事人必須共同到中國公民一方戶口所在地的省、自治區、直轄市人民政府指定的婚姻登記機關申請登記。二、申請結婚登記的男女雙方，必須遵守中華人民共和國婚姻法和本規定的有關條款。三、申請結婚登記的中國公民和外國人，須分別持有下列證件：甲、中國公民：（一）本人的戶籍證明：（二）本人戶口所在地的縣級人民政府或工作所在單位的縣級以上機關、學校、事業、企業單位出具的本人姓名、性別、出生年月、民族、婚姻狀況（未婚、離婚、喪偶、下同）、職業、工作性質、申請與何人結婚的證明。乙、外國人：（一）本人護照或其他身份、國籍證件；（二）公安機關簽發的《外國人居留證》，或外事部門頒發的身份證件，或臨時來華的入境、居留證件；（三）經本國外交部（或外交部授權機關）和我駐該國使、領館認證的由本國公證機關出具的婚姻狀況證明；或該國駐華使、領館出具的婚姻狀況證明。丙、外國僑民：（一）本人護照或代替護照的身份、國籍證件（無國籍者免交）；（二）公安機關簽發的《外國人居留證》；（三）本人戶口所在地縣級人民政府或工作所在單位的縣級以上機關、學校、事業、企業單位出具的本人姓名、性別、出生年月、婚姻狀況、職業、申請與何人結婚的證明。此外，申請結婚的男女雙方，還須提交婚姻登記機關指定醫院出具的婚前健康檢查證明。四、下列中國公民不準同外國人結婚：（一）現役軍人、外交人員、公安人員、機要人員和其他掌握重大機密的人員；（二）正在接受勞動教養和服刑的人。五、凡證件齊全、符合本規定的中國公民和外國人，可持證件和男女雙方照片，到婚姻登記機關提出申請。經婚姻登記機關審查了解，符合中華人民共和國婚姻法和本規定的準予登記，一個月內辦理登記手續，發給結婚證。結婚證須貼有男女雙方當事人照片，并加蓋辦理涉外婚姻登記的縣級以上人民政府婚姻登記專用章（鋼印）。六、中國公民和外國人在華要求離婚的，應按中華人民共和國《民事訴訟法（試行）》有關規定，向該管人民法院提出離婚訴訟。要求復婚的，按結婚辦理。七、申請結婚的中國公民和外國人應向婚姻登記機關交納婚姻證書工本費和登記手續費。所需翻譯費由本人自理。八、本規定經國務院批準后施行，過去有關規定同時廢止。 PROVISIONS FOR THE REGISTRATION OF MARRIAGE BETWEEN CHINESECITIZENS AND FOREIGNERS Important Notice: (注意事項)英文本源自中華人民共和國務院法制局編譯, 中國法制出版社出版的《中華人民共和國涉外法規匯編》(1991年7月版).當發生歧意時, 應以法律法規頒布單位發布的中文原文為準.This English document is coming from "LAWS AND REGULATIONS OF THEPEOPLE S REPUBLIC OF CHINA GOVERNING FOREIGN-RELATED MATTERS" (1991.7)which is compiled by the Brueau of Legislative Affairs of the StateCouncil of the People s Republic of China, and is published by the ChinaLegal System Publishing House.In case of discrepancy, the original version in Chinese shall prevail. Whole Document (法規全文)PROVISIONS FOR THE REGISTRATION OF MARRIAGE BETWEEN CHINESECITIZENS AND FOREIGNERS(Approved by the State Council on August 17, 1983 and promulgatedby the Ministry of Civil Affairs on August 26, 1983)1. When Chinese citizens and foreigners (including foreign residents andthose who come to China for a short visit, Chinese of foreign nationality,and foreigners who have settled down in China) decide to get married oftheir own free will within the boundaries of China, both the man and thewoman concerned shall appear together at the marriage registrationdepartment, designated by the province, autonomous region, or municipalitydirectly under the Central Government, and stationed in the locality wherethe Chinese citizen has his/her residence registration and apply formarriage registration.2. Both the man and the woman, who apply for marriage registration, shallabide by the Marriage Law of the People s Republic of China and thepertinent articles and items of these Provisions.3. Chinese citizens and foreigners who apply for marriage registrationshall respectively hold the following certificates:A. For Chinese citizens:(1) certificates of the applicant s residence registration;(2) certificate signed and issued either by the people s government at thecounty level or above which is stationed in the locality where theapplicant has his/her residence registration, or by a governmentdepartment, a school, an institution, or an enterprise at the county levelor above, which is the applicant s place of work; the certificateindicates the applicant s name, sex, date of birth, nationality, maritalstatus (single, divorced, bereft of spouse - the same below), occupation,nature of work, name of the person to marry.B. For foreigners:(1) the applicant s passport or other documents certifying his/heridentity and citizenship;(2) "Residence Permit for Foreigners" signed and issued by the publicsecurity department, or identification certificate issued by foreignaffairs department, or entry permit and residence permit for foreignerswho come to China for a short stay;(3) marital status certification issued by the notary office of theapplicant s country and confirmed by both the Ministry of Foreign Affairs(or a department authorized by the Ministry of Foreign Affairs) of theapplicant s country and the Chinese embassy or consulate in the saidforeign country; or marital status certification issued by the embassy orconsulate of the said foreign country in China.C. For resident foreigners in China:(1) the applicant s passport, or identification certificate or nationalitycertificate used to substitute for passport (those who have no nationalitymay be exempted from presenting their nationality certificates);(2) "Residence Permit for Foreigners" signed and issued by the publicsecurity department;(3) certificate signed and issued either by the people s government at thecounty level or above, which is stationed in the locality where theapplicant has his/her residence registration, or by a governmentdepartment, a school, an institution, or an enterprise at the county levelor above, which is the applicant s place of work; the certificateindicates the applicant s name, sex, date of birth, marital status,occupation, name of the person to marry.In addition, both the man and the woman applying for marriage registrationshall also present the pre-marital health check-up report signed and issued by a hospital designated by the marriage registration department.4. The following Chinese citizens shall not be permitted to marryforeigners:(1) armymen in active service, diplomatic personnel, public securitypersonnel, confidential personnel, and other personnel who are in chargeof important confidential work;(2) persons who are receiving reeducation through labour or serving asentence.5. Chinese citizens and foreigners, who hold all the required certificatesand accord with these Provisions, may present their certificates andphotos to the marriage registration department and make an application.The marriage registration department, after examining the application andconfirming through investigation that the application conforms to theMarriage Law of the People s Republic of China and to these Provisions,shall give the applicants the permission to register, and to go throughthe registration procedures within 1 month; and then the marriageregistration department shall issue the marriage certificate to them. Themarriage certificate shall be attached with the photos of both the man andthe woman, and be affixed with the special seal (made of steel) formarriage registration of the people s government at the county level orabove which handles the registration of marriage between Chinese andforeign nationals.6. If a Chinese citizen and a foreigner request a divorce in China, theyshall, in accordance with the pertinent provisions of "The Civil ProcedureLaw of the People s Republic of China (for Trial Implementation)", file adivorce suit with the appropriate People s Court. Those who wish to resumemarriage relationship shall go through the same registration procedures asthose for marriage.7. Chinese citizens and foreigners who apply for marriage registrationshall pay for the cost of marriage certificates and also pay aregistration service charge. The expenses for interpretation service shallbe borne by the applicants.8. These Provisions shall go into effect upon approval by the StateCouncil, and all former pertinent provisions shall be null and void at thesame time.
